Our bankruptcy lawyer, James O. Cure, can talk to you about your options for discharging income tax debt. He is board certified in Texas as a specialist in bankruptcy law.* With more than 34 years of experience, he can provide the skilled legal help you need. He can quickly determine if you meet the qualifications for tax relief under Chapter 7 and Chapter 13.

  • Income taxes that are not in the following categories can be discharged in Chapter 7 bankruptcy : taxes included in a tax return that was due to be filed within three years before the bankruptcy filing; taxes that the IRS assessed within 240 days before bankruptcy filing; taxes that have not been assessed but still could be; taxes included in a tax return that was filed late and within two years before bankruptcy filing and taxes that were filed fraudulently.
  • Chapter 13 bankruptcy handles tax debt quite differently than Chapter 7. When taxes are considered nondischargeable in Chapter 13, they must be paid in full without interest in the repayment plan.
